Welcome to Pitch Peach! These Terms and Conditions ("Terms") govern your use of our services and membership offerings. By engaging with Pitch Peach, you agree to the following:

1. Definitions

• Company, we, us, or our: Pitch Peach
• Client, you, or your: Any individual or business engaging our services
• Services: Our PR membership model, media outreach, and interview opportunities

2. Membership & Services

2.1 Membership Plans:
Pitch Peach offers:

• Two membership plans for brands, designed to fit different levels of visibility and support
• One membership plan for agencies, offering agency-level access to multiple clients and interviews

Memberships are month-to-month with no long-term contracts, and each plan includes defined services outlined at onboarding.

2.2 Pay-Per-Interview Model:
In addition to your membership, Pitch Peach operates on a pay-per-interview model. Fees apply to each confirmed media opportunity, including interviews, contributed features, or expert inclusions. All fees are communicated in advance.

2.3 No Guarantees:
While we actively pitch and secure opportunities, media placements and publication outcomes are not guaranteed.

3. Payments & Billing

3.1 Monthly Billing Cycle:
Your membership fee and any applicable interview fees will be billed on the same day each month at the start of your billing cycle using the payment method on file.

3.2 Pay-Per-Interview Billing:
Interview fees are charged under the following conditions:

• Once an interview or media opportunity is confirmed, or
• Upon completion or participation in the interview, whichever occurs first

All interview fees are earned upon confirmation and are non-refundable, regardless of publication status or outcome.

3.3 Failed Payments & Payment Links:
If a payment fails, we will attempt to process it up to three times. If all three attempts fail, we will send a payment link via email. Payment must be completed within 24 hours of receiving the link. Failure to do so will result in cancellation of your membership until payment is received.

3.4 Authorization:
By engaging Pitch Peach, you authorize us to charge your card on file for all membership and interview fees in accordance with these Terms.

3.5 Refund Policy:
Due to the nature of PR services and secured opportunities, all payments are non-refundable, including membership and interview fees.

4. Client Responsibilities

4.1 Timely Participation:
Clients agree to respond within 24 hours to interview requests, deadlines, and media opportunities. If a client commits to an opportunity and misses the agreed-upon deadline, they will be charged 50% of the placement fee for that opportunity. If three opportunities are declined within a given monthly cycle, the membership will be paused until further notice.

4.2 Accuracy of Information:
You are responsible for ensuring all submitted information, quotes, and materials are accurate and approved for media use.

4.3 Professional Conduct:
Clients agree to represent themselves and Pitch Peach professionally in all media interactions.

5. Intellectual Property

5.1 Company Materials:
All Pitch Peach processes, materials, and content remain the intellectual property of the Company.

5.2 Client Content:
You grant Pitch Peach permission to use submitted materials (bios, headshots, quotes, etc.) for the purpose of securing and fulfilling media opportunities.

6. Limitation of Liability

Pitch Peach provides services on an "as is" basis and makes no warranties regarding outcomes.
Our total liability shall not exceed the total fees paid by the client in the prior six (6) months.

7. Termination

7.1 By Client:
You may cancel your membership at any time prior to your next billing cycle.

7.2 Outstanding Balances:
Any confirmed interviews or completed opportunities prior to cancellation remain billable and due in full, regardless of membership status.

7.3 By Company:
We reserve the right to terminate services at our discretion for non-payment, failure to respond to interview opportunities, or breach of these Terms.

8. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes will be resolved in the appropriate courts of that jurisdiction.

9. Updates to Terms

Pitch Peach may update these Terms periodically. Continued use of our services constitutes acceptance of any updates.
